Metcalfe Projects – Terms & Conditions of Sale

1. Registration and Bidding
1.1. All prospective purchasers must register with Metcalfe Projects prior to bidding. We reserve the right to refuse registration at our sole discretion.
1.2. Bidding is a legally binding contract. Once a bid is placed, it cannot be withdrawn and, if successful, constitutes a commitment to purchase.
1.3. All lots are offered subject to a reserve price unless otherwise stated.
1.4. Metcalfe Projects reserves the right to withdraw or re-offer any lot at any point during the auction process.

2. Descriptions and Inspection
2.1. All lots are sold “as seen,” with no warranties or guarantees, whether express or implied, unless stated otherwise in writing.
2.2. All descriptions, mileages, hour readings, and specifications are provided in good faith but should not be relied upon as statements or representations of fact.
2.3. Viewing is strongly advised, and it is the bidder’s responsibility to inspect items prior to bidding.

3. Payment Terms
3.1. All purchases must be paid for in full within three (3) working days of the sale. Accepted payment methods are bank transfer or debit card.
3.2. No items will be released until cleared payment has been received in full.
3.3. Any payment not received within the stated time will be considered overdue and may result in the cancellation of the sale and relisting of the item.

4. Collection of Goods
4.1. Items must be collected within seven (7) calendar days of the sale’s close. Storage charges of £28 + VAT per day may apply after this period.
4.2. Collection is by appointment only. Buyers must arrange transport and loading—Metcalfe Projects does not offer loading facilities unless specifically stated.

5. Title and Risk
5.1. Risk in the goods passes to the buyer upon acceptance of their bid. Title passes only upon full payment being received by Metcalfe Projects.
5.2. Buyers are responsible for insuring their goods immediately after purchase.

6. Export and VAT
6.1. All bids and payments are made in GBP (£) and are subject to VAT unless specified otherwise.
6.2. For export sales, VAT may be refunded upon provision of valid proof of export in accordance with HMRC rules.

7. Default by the Buyer
7.1. Failure to comply with these terms may result in cancellation of the sale, resale of the goods, and/or a claim for damages and losses incurred.
7.2. Metcalfe Projects reserves the right to recover any costs resulting from the buyer’s default, including storage, legal fees, and resale losses.

8. Liability
8.1. Metcalfe Projects accepts no liability for loss or damage to goods once they have been sold and are the buyer’s responsibility.
8.2. Under no circumstances shall Metcalfe Projects be liable for any indirect or consequential losses.

9. Law and Jurisdiction
9.1. These Terms & Conditions are governed by English law. Any disputes arising under or in connection with them will be subject to the exclusive jurisdiction of the courts of England and Wales.
